Guest Portal Wi-Fi Terms of Use

Effective: January 1, 2026

Welcome to the Mountain America Credit Union (“Mountain America”) Guest Wi-Fi network (“Service”). By accessing or using this Service, you acknowledge that you have read, understood, and agree to comply with these Terms of Use. If you do not agree, please disconnect from the network.

1. Acceptance of Terms

By using this Service, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into this agreement. If you are under 18 years old, you may only use the Service with the consent and supervision of a parent or legal guardian, who must accept these Terms on your behalf. Your electronic acceptance of these Terms by clicking “Accept” has the same effect as signing a written agreement.

2. Service Description and Availability

Mountain America provides this Wi-Fi Service free of charge solely for the use of authorized guests of Mountain America. Access by any other individuals is strictly prohibited. Mountain America reserves the right to determine who qualifies as an authorized guest and to restrict or terminate access at its sole discretion. Service availability, coverage, and quality are not guaranteed and may be changed, suspended, or discontinued at any time without notice. Mountain America may assign you an IP address each time you access the Service. The IP address may change at any time.

3. Lawful and Acceptable Use

You agree to use this Service only for lawful purposes and in a manner consistent with the rights of other users. Prohibited activities include, but are not limited to:

  • Violating any applicable local, state, federal, or international law or regulation.
  • Transmitting, distributing, or storing material that is obscene, defamatory, harassing, threatening, or otherwise objectionable, including any material that Mountain America, in its sole discretion, determines to be inappropriate or in violation of these Terms.
  • Infringing upon the intellectual property, privacy, or publicity rights of others.
  • Engaging in fraudulent, criminal, or malicious activity, including unauthorized access to accounts, systems, or data.
  • Distributing viruses, malware, or other harmful software.
  • Sending unsolicited bulk communications (“spam”).
  • Attempting to disrupt, degrade, or interfere with the network or other users.
  • Accessing, collecting, or maintaining information about other users or third parties for unauthorized purposes.
  • Reselling or redistributing the Service without Mountain America’s express written authorization.
  • Using the Service for high-volume data transfers, hosting servers, or other activities that may degrade network performance.

Mountain America reserves the right to monitor, restrict, block, or terminate access for any activity it deems inappropriate or unlawful. You understand and agree that Mountain America may disclose your communications and activities using the Service in response to lawful requests by governmental authorities and judicial orders.

4. User Responsibilities

  • You are responsible for the security and integrity of your own devices and data.
  • You should use up-to-date antivirus software and take appropriate security precautions.
  • You are responsible for all activity conducted through your device while connected to the Service.
  • You must not attempt to circumvent or subvert system or network security measures.
  • You must not impersonate any person or entity or misrepresent your affiliation with any person or entity.

5. Privacy and Monitoring

This is an open, unsecured network. Mountain America does not guarantee the privacy or confidentiality of any communications over this Service. Network activity may be monitored, logged, and disclosed to law enforcement or regulatory authorities if required by law or when necessary to protect Mountain America’s rights or property. By using the Service, you consent to such monitoring and disclosure.

6. Security Disclaimer

Wireless communications are inherently insecure. Mountain America strongly recommends that you avoid transmitting sensitive or personal information over this network. Mountain America does not provide encryption or additional security beyond basic network access. You assume all risks associated with the use of an unsecured wireless network.

7. Disclaimer of Warranties and Liability

The Service is provided “as is” and “as available,” without any warranties of any kind, express or implied. Mountain America expressly disclaims all warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, and title. Mountain America does not guarantee uninterrupted, error-free, or secure access, or that the Service will be free of viruses or other harmful components.

To the maximum extent permitted by law, Mountain America and its officers, employees, agents, affiliates, suppliers, and licensors are not liable for any direct, indirect, incidental, consequential, special, exemplary, or punitive damages, including loss of data, profits, business, or goodwill, arising from or related to your use or inability to use the Service, even if Mountain America has been advised of the possibility of such damages. You assume all risks associated with the use of this network.

8. Indemnification

You agree to defend, indemnify, and hold harmless Mountain America, its officers, directors, team members, agents, affiliates, suppliers, and licensors from and against any and all claims, demands, actions, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of, based upon, resulting from, or in any way connected with your use of the Service, your violation of these Terms of Use, or your violation of any law or the rights of any third party. You agree that Mountain America shall have the right to participate in the defense of any such claim at its own expense. You may not settle any claim without the prior written consent of Mountain America.

9. Termination of Access

Mountain America reserves the right to suspend or terminate your access to the Service at any time, without notice, for any reason, including violation of these Terms of Use, security or safety reasons, or for any or no reason at all. In the event of such termination, Mountain America will have no liability to you.

10. Changes to Terms

Mountain America may modify these Terms of Use at any time. Such modifications shall be binding and effective upon posting on the Service login page or Mountain America website. By continuing to use the Service after such postings, you accept and agree to any and all such modifications.

11. Governing Law

These Terms of Use are governed by and construed in accordance with the laws of the State of Utah, without regard to its conflict of law principles. If any provision of these Terms is found to be unenforceable, the remainder will remain in full force and effect.
